No Objection Certificate for Marriage


  • ​Some countries require a No objection certificate to marry before local authorities. This certificate is also commonly issued to process a marriage application for a consular marriage ceremony or for registering a civil partnership in Spain.
  • Who can apply: Spanish citizens registered as residents in India, Nepal, Bhutan, Sri Lanka and Maldives, as well as Spanish citizens whose partners reside within this consular district, may apply for this certificate.​​
  • Foreigners requiring a No objection Certificate for marriage should contact the authorities of their country of nationality.

Requirements 

In addition to the documents listed below, the Consular Section of this Embassy may request additional information or documents when necessary to assess the application:

  1. Original and copy of the Spanish citizen's National Identity Document (DNI).
  2. Original and copy of the foreign citizen's passport. 
  3. Declaration of marital status. Download here​It opens in new window.
  4. Birth certificate issued by the Spanish Civil Registry within the last 6 months. This certificate is not required if the birth is registered at this Consular Section of this Embassy.
  5. If the applicant is divorced: divorce decree and a copy of the previous marriage certificate with marginal note. 
  6. If the applicant is widowed: previous marriage certificate and the spouse's death certificate.

Procedure

The certificate of legal capacity to marry requires the applicant's physical presence at the Consular Office of your residence. 

  • To apply for the certificate in India and Bhutan: You must send an email to emb.nuevadelhi.rgc@maec.es to schedule an in-person appointment at the Consular Section in New Delhi.
  • To apply for the certificate in Nepal, Sri Lanka, and Maldives: You must send an email to emb.nuevadelhi.rgc@maec.es​ to schedule an appointment at the respective Honorary Consulate. Once the appointment is scheduled, the applicant must go to the corresponding consular office for identification, and video call with the Head of the Consular Section in New Delhi.

The certificate (in English) will be sent by email, electronically signed by the Head of the Consular Section of the Embassy of Spain in New Delhi.
