Universal Periodic Review of Spain

​On Wednesday, Spain presented its report corresponding to the Third Cycle of the Universal Periodic Review (UPR), which covers the period from 2015 to 2020. The UPR is a mechanism of the Human Rights Council that allows for policies and legislation on human rights matters to be assessed every five years and to table dialogue with other Member States.

The State Secretary for Foreign Affairs, Fernando Valenzuela, who headed up an extensive delegation of representatives of the ministerial departments and institutions involved, presented the regulatory and institutional progress made on the matter, as well as the specific measures implemented since 2015 in such fields as the fight against gender-based violence and equality between men and women at work; the right to suffrage of persons with disabilities; the fight against child poverty; the restoration of universal public health and the right to housing. The State secretary also announced the parliamentary passage in the near future of diverse legislative initiatives, such as the Comprehensive Law for Equal Treatment and Non-discrimination, the Comprehensive Law for Protection from Violence against Children, the Comprehensive Law to Combat the Trafficking of Women and Girls for Purposes of Sexual Exploitation and the new Constitutional Law on Education, as well as the second National Human Rights Plan.

117 States took part in the session, which acknowledged the improvements and good practices developed by Spain on human rights matters since 2015. With a constructive approach, the delegations made recommendations to Spain to continue developing the fight against racial discrimination, xenophobia and other forms of intolerance; the reception of migrants and asylum-seekers; and the amendment of the criminal treatment of the offences of defamation and libel with a view to strengthening the exercise of the freedom of expression. The Member States also referred to such new challenges as the relationship between the environment and human rights, and the demographic challenge.

In the coming months, Spain will study each of the recommendations received in order to subsequently work on their application. This will allow the path taken in the previous cycle of the UPR to continue to be followed; 80% of the recommendations made in 2015 have been complied with.

The State secretary reiterated Spain’s commitment to the UPR as an exercise in transparency and reflection that serves as a guide for progress in promoting and protecting human rights.
