Spain rejects U.S. announcement of implementation of Title III of the Helms-Burton Act

​Spain rejects the decision announced this afternoon by the Secretary of State of the United States of America, Mike Pompeo, not to renew the suspension of Title III of the Helms-Burton Act (Cuban Liberty and Democratic Solidarity Act or Libertad Act).

The Government of Spain considers that the application of Title III does not contribute to our common objective of continuing to promote democracy, political openness and human rights in Cuba.

Dissuading and penalizing trade and investment operations of companies from third States in the Island is against the interests of Spain and other European partners in Cuba. It also deteriorates bilateral relations between allied countries, in addition to seriously harming the well-being of the Cuban population.

The extraterritorial application of the legislation is contrary to International Law and will give rise to a spiral of demands and counter-demands that will disturb the transatlantic economic relationship without giving rise to any advantage or advance, either for the US claimants or for the Cuban population as a whole.

Spain is actively working together with the European Commission, the other EU Member States and other international partners to adopt all appropriate measures in multilateral fora to defend our interests and the future of Spanish companies in Cuba. In particular, the EU is considering different options in order to protect its interests, both within the framework of the World Trade Organisation and through the EU's Statute of Deadlock.

Spain wishes to reiterate its transatlantic commitment and its responsibility to advance openness, democracy and respect for human rights in Cuba. It also vindicates the work of the European Union, whose impact on the Cuban democratisation process has been most marked when efforts have been joined with the United States and other international partners.

The Government of Spain expresses its categorical rejection of this decision of the US Administration, and invites it to continue working together with Spain and the European Union in favour of political and democratic reform in Cuba.
