TRAVEL TO SPAIN under covid-19- RESTRICTIONS AND EXCEPTIONS

1.         RESTRICTIONS for TRAVEL and EXCEPTIONS
 
Orders of the Ministries of Interior and Health of Spain, in accordance with European Union regulations, establish a TEMPORARY RESTRICTION of NON ESSENTIAL TRAVEL from THIRD COUNTRIES to the EUROPEAN UNION and associated countries Schengen for reasons of public order and public health due to the health crisis caused by COVID-19.  Several EXCEPTIONS apply. Some of the exceptions need a PREVIOUS AUTHORIZATION.
 
Tourists can enter Spain since 7 June 2021 presenting a certificate of full vaccination (exception k).
   
OMAN is affected by these restrictions. But citizens and residents in Oman can travel to Spain under certain exceptions, including having a full vaccination certificate.
 
EXCEPTIONS

which modify Order INT/ 657/2020, of July 17:
 
Entry to Spain from third countries can be possible for:
 
a. Ordinary residents in the European Union, Schengen Associated States, Andorra, Monaco, The Vatican (Holy See) or San Marino who are travelling to their country of residence providing documentary proof.
 
b. Holders of a long-stay visa issued by a Member State (or Schengen Associated State) who are heading to that country.
 
c. Health professionals, including health researchers, and elderly care professionals who are heading to or returning from their work activity.
 
d. Transportation personnel, sailors and aeronautical personnel necessary to carry out air and sea transport activities.
 
e.  Diplomatic, consular and international organizations personnel, military, civil protection staff and members of humanitarian organizations, in the exercise of their functions.
 
f. Students who carry out their studies in the Member States or Schengen associated States and who have the corresponding long term permit or visa and medical insurance, as long as they go to the country where they are studying, and that the entry occurs during the academic year or the previous 15 days.
 
If the destination is Spain and the duration of the stay is up to 90 days, it must be proven that the studies are carried out in an authorized teaching center in Spain, registered in the corresponding administrative register, following during this phase a full-time and face-to-face program, and that leads to obtaining a degree or certificate of studies
 
g. Highly qualified workers whose work is necessary and cannot be postponed or carried out remotely. These circumstances must be justified by documentation.
      - Participants in high-level sport events that take place in Spain. They should justify this case with a certificate issued by the Supreme Council of Sport of Spain (Consejo Superior de Deportes).
 
h. Persons traveling for duly accredited imperative family reasons.
 
i. Persons who document reasons of force majeure or situation of need, or whose entry is allowed for humanitarian reasons.
 
j. Residents of the following countries, OMAN not included, as long as they come directly from them, have transited exclusively through other countries included in the list, or have carried out only international transits at airports located in countries that are not in the list:
 
Australia, Israel, Japan, New Zealand, Singapore, South Korea, Armenia, Azerbaijan, Bosnia and Herzegovina, Brunei, Canada, Jordan, Montenegro, Qatar, Republic of Moldova, Republic of North Macedonia, Saud Arabia, China, Albania, Lebanon, Serbia, United States of America and Ucrania.
 
And subject to reciprocity: China and special administrative regions of Hong Kong and Macao.
 
Entities and territorial authorities not recognized as States by at least one Member State of the European Union: Kosovo and Taiwan.
 
k. Non-essential trips of vaccinated people:  People with a vaccination certificate that the Ministry of Health of Spain recognizes for this purpose, after verification by the health authorities, as well as accompanying minors to whom the Ministry of Health of Spain extends the effects.
 
  Third country accompanying minors:
 
 -Under 12 years of age: are exempt from presenting any type of health certificates. However they must have the QR code obtained after completing the health control form.
 
- Minors from 12 to 18 years old:
 
1) If they travel under one of the above exceptional causes of Order 552, they must have any of the 3 accepted certificates (vaccination, negative test or recovery from the disease).
 
2) If the justifying cause of the trip is the exception contemplated in section k) of the aforementioned Order 552 (non-essential trips of vaccinated people), they must provide the vaccination certificate.
 
 
Persons who also fall within the EXCEPTIONS even if they are not vaccinated:
 
·        immediate family members of a national of an EU Member State traveling together or traveling to join the national of an EU Member State;
 
·        Passengers who are unmarried partners of nationals of Spain. They must have a confirmation of their relationship issued by the Embassy of Spain based on documentation of proof;

·        Persons travelling for BUSINESS PURPOSES should justify the importance of the trip for the interests of Spain. Procedure: the applicant should present all the supporting documents that justify the trip, so that the Commercial Office of the Embassy of Spain issues the corresponding certificate. When the certificate is positive, the applicant should obtain the visa, and then the corresponding authorization for his entry in Spain will be issued.
 
PREVIOUS AUTHORIZATION is required for the EXCEPTIONS g), h), i), or for business purposes, if the traveller is not vaccinated:
 
In these cases, in addition to your Schengen visa, you must duly provide the necessary documents related to the trip (in connection with the specific exception), in order to get an authorization which will be issued by the Embassy (and in which all the details of the flight should appear).
 
Please send to the Embassy of Spain: a letter specifying as well as the purpose of your trip, the person / s that will be traveling, date of entry, duration of stay in the Spanish territory, and any other details.
 
These documents must be presented as well at the entry border in Spain to the police authorities.
 
Important: EVERY TIME you travel, you must document the reason, duration, details of the entry, etc. and obtain an authorization.
 
 
2.         REQUIREMENTS TO TRAVEL FROM OMAN TO SPAIN
 
·         Passengers must complete an "Health Control Form" FCS, Spain Travel Health:
 
You must complete the entire Form from the website https://www.spth.gob.es/ or the app and sign it, and from 48 hours before the flight you can send the form to the health authorities. Once sent, you will receive an email with a QR Code that will allow you to access the destination airport. You must have it printed or on your mobile phone.
 
You may begin to fill out the form at any time, prior to your trip, except for the sections corresponding to health questions and travel history, which will be available 2 days before your arrival in Spain. 
 
·         All passengers arriving in Spain from a country / zone of risk (Oman) must have a valid health certificate to enter Spain, which can be:
    1. A vaccination against covid-19 certificate,  (letter “k” of the exceptions)
For the other exceptions:
    1. A certificate of SARSCoV2 diagnostic test taken 48 h before arrival in Spain with negative result,
    2. A covid-19 recovery certificate,
 
These certificates can be added to the SpTH application, during the process of obtaining the QR code.
The certificate must be in English, French, Germany, and Spanish or accompanied by a certified Spanish translation.
 
·        Passengers vaccinated with a complete regime, with any vaccine authorized for marketing by the European Union (European Medicines Agency, EMA) and  the World Health Organisation’s emergency use process (WHO), at least 14 days before arriving in Spain, should not provide any additional diagnostic test. However, it is possible that they may be subject to a diagnostic test upon arrival if the health authority deems it necessary.
 
Vaccines accepted: currently, these vaccines are those produced by Pfizer-Biontech, Moderna, Astra-Zeneca, Jansen/Johnson&Johnson, Sinovac and Sinopharm
 
Vaccination certificate:  it must contain the following information:
Name and surname of the holder. Date of vaccination, stating the date of the last dose administered. Type of vaccine administered. Number of doses administered/complete schedule. Issuing country. Identification of the institution issuing the certificate of vaccination.
 
Validity of the certificate of vaccination: from 14 days after the complete vaccination schedule, up to 1 year after the date of vaccination.
 
 
 
·         Passengers are subject to medical screening upon arrival.
 
·         In order to allow boarding of passengers bound for Spain, airlines, at the airport of origin, will check that passengers have the QR code generated through the website www.spth.gob.es, or the Spain Travel Health -SpTH application and travellers form Oman as risk country/area may be asked to show the document certifying vaccination, diagnostic test or recovery of COVID-19, which has been used to obtain the QR code.
 
The list of risk countries or areas is published every fifteen days on the website of the Ministry of Health ( www.mscbs.gob.es ) and on the website of Spain Travel Health -SpTH ( www.spth.gob.es ). Any change in the affected territories will be effective 7 days after its publication.
 
Every national of a third country will be subject to denial of entry, for reasons of public order or public health, -even if they belong to one of the categories of exemptions listed above. -, if after verification by the health authorities, the person does not comply with the health control requirements for COVID-19 established by the Spanish Ministry of Health.
