Criminal record certificates

​By issuing criminal record certificate, the Spanish Ministry of Justice can certify the absence or existence of a criminal record in its Central Register of Convicted Persons.

Any individual of legal age or legal entity, Spanish or foreign, directly or through their legal representative, can apply for a criminal record certificate. Individuals with limited legal capacity must be represented by a parent or legal guardian.

If the applicant is a national of a Member State of the European Union other than Spain, the Ministry of Justice will request information from the central authority on criminal record of the country of which the applicant is a national. This information will be attached to the Spanish certificate. In this case, the processing of the certificate will be subject to the regulations, practice and deadlines of the concerned country.
The form used to request the Ministry of Justice to issue a criminal record certificate is form 790, which is also used to request certificates of Last Wills and Death Cover Insurance Contracts. The certificate consists of three copies: one for the applicant, one for the Ministry of Justice and one for the bank that will collect the applicable fee.
If the certificate is to have effect out of Spain, the country and authority or entity before which it is to have effect must be indicated on the application form. The Ministry of Justice will issue a certificate with The Hague Apostille. That certificate will be recognized in all member countries of the Hague Convention No 12. Since 16 February 2019, negative criminal record certificates (and documents issued by the Civil Registries) are effective in all EU Member States without the need for legalization or apostille.
Criminal record certificates do not entitle to work in Spain with minors. It is the Certificate of Offences of a Sexual Nature, also issued by the Ministry of Justice, which authorizes the exercise of this activity.
The administrative fee charged by the Ministry of Justice for the issuance of the Criminal Record Certificate (fee 006) is currently €3.82.
Residents of the Republic of Ireland have several ways of applying for and obtaining acriminal record certificate made available to citizens by the Ministry of Justice, depending on their nationality.
1) Application for an electronic certificate of criminal record at the website of the Ministry of Justice
Spaniards who have an electronic ID card or electronic signature certificate can use this method. On the Ministry of Justice website, they should choose Tramitación online con CL@VE. The applicant identifies himself/herself, signs the application form and pays the applicable administrative fee. Payment of the fee is made through the administrative fee payment gateway between the Ministry of Justice and the Tax Agency.
The electronic criminal record certificate is issued, with few exceptions, on the spot.
If you have an electronic ID card or electronic signature certificate, you can just check the absence of a criminal record without having to pay a fee at the Ministry of Justice's website.
2) By post to the Ministry of Justice
Spanish or foreign residents in the Republic of Ireland can apply for a criminal record certificate from the Ministry of Justice by sending to it the necessary documents by post. You can request that the criminal record certificate be sent to you by post or by e-mail. If the certificate is to be subsequently subjected to diplomatic authentication or if it is accompanied by information from another EU Member State, it will not be possible to send it by e-mail.
The Ministry of Justice issues criminal records certificates within 21 working days after reception of the application.
The address to which the documentation should be sent is: Registro Central de Penados y Rebeldes, Ministerio de Justicia, San Bernardo 45, 28015-Madrid, España or any Gerencia Territorial del Ministerio de Justicia.
The applicant must send the following documents to the Ministry of Justice:
- Copies for the Administration and for the collaborating bank of the application form (formulario790), completed on computer, printed and signed.
- Copy of the passport certified by this Spanish Embassy (you will have to pay the consular fee that applies to a certified copy). Get an appointment to have a copy of your passport certified.
- Proof of payment of the applicable fee, together with the Administration's copy of the application form. If you are making the transfer from an account outside Spain, you must pay the fee into this account:

3) In person in Spain before the competent authority
Spaniards or foreigners can apply directly at either the Registro Central de Penados y Rebeldes, Ministerio de Justicia, San Bernardo 45, 28015-Madrid, España, or any Provincial Office of the Ministry of Justice. As a rule the certificate is issued on the spot.
4) Application in person at this Embassy of Spain and subsequent collection in Spain, in person or by representative
Any Spaniard over 18 years of age, resident in the Republic of Ireland and registered in the Registro de Matrícula of this Embassy can come to this Embassy to apply for a criminal record certificate. Get an appointment at the Embassy to apply for a criminal record certificate.
The Embassy sends the application to the Ministry of Justice electronically. 
The Spanish applicant can then collect the certificate in person in Spain or delegate a representative to do so.
The applicant must come to the Embassy with:
- DNI, original and a copy, to be certified (the applicant must pay the consular fee applicable to the certification).
- Form with personal details, the office in Spain of the Ministry of Justice where the applicant intends to collect the certificate and, if the applicant is not going to collect it himself/herself, the personal details of his/her representative.with personal details, the office in Spain of the Ministry of Justice where the applicant intends to collect the certificate and, if the applicant is not going to collect it himself/herself, the personal details of his/her representative.
For the subsequent collection of the certificate in Spain, the applicant or his/her representative must first make an appointment at the Registro Central de Penados y Rebeldes in Madrid or at the Territorial Management Office of the Ministry of Justice that he/she has indicated and provide the following documentation:
- Application form (formulario 790) completed, printed and signed.
- Proof of payment of the applicable fee (fee 006), together with the Administration's copy of the application form.
If the applicant pays the fee from an account outside Spain, the amount must be transferred to the following account.

5) Before the Garda Criminal Records Office
In accordance with Article 6 of Council Framework Decision 2009/315/JHA of 26 February 2009 on the organization and content of the exchange of information extracted from criminal records between Member States, Irish nationals may apply to the Garda Criminal Records Office to submit an application for a criminal records certificate in Spain.
