Residence visas under Law 14/2013
 
The information attached hereunder covers the residence visas created by Law 14/2013, dated 27 September, of support to entrepreneurs and their internationalization. You may find more information in the Law itself (english translation), in this presentation (.pdf) or the brochure (.pdf).
 
Before purchasing a property in Spain, you must inform yourself properly of the different steps to be taken. You may find more information in the guide (.pdf) published by the Association of Land Registrars of Spain.
 
The visas regulated in this Law are the following:
 
- Residence visas for capital investors (brochure .pdf)
- Residence visas for buyers of real estate  (brochure .pdf).
- Residence visas for entrepreneurs and entrepreneurial activities  (brochure .pdf).
- Residence visas for highly qualified professionals  (brochure .pdf).
- Residence visas for educational or research activities  (brochure .pdf).
- Residence visas for intra-company moves (brochure .pdf). 
 
The Law establishes the following COMMON REQUIREMENTS to all these categories:   
  1. Applicant must be above 18 years old.
  2. Application form (can be downloaded from both VFS and the Embassy of Spain’s Websites)
    1. Fully completed in English or Spanish and signed and dated by the applicant himself.
    2. If the applicant is under the age of 18, both parents or legal guardian must sign a “Letter of consent”; passport copies of the father and mother have to be attached. 
  3. Two recent biometric passport sized photographs with the following requirements:
    1. pictures must comply with EU recommendations (can be consulted in this Website)
    2. Should not be older than 6 months.
  4. Passport
    1. passport must include a valid UAE residence permit with a minimum validity of six months after the date of issuance of the visa
    2. passport must have a minimum validity of 6 months from the date of issuance of the requested visa.
    3. Signed by bearer
    4. Passport not older than 10 years
    5. Undamaged pictures securely affixed with/to passport
    6. Previous passport if applicable
  5. Overseas medical insurance:
    1. Valid for the duration of the requested visa and all Schengen countries.
    2. must cover all risks expected during the time of stay in the Schengen area, including repatriation
    3. minimum coverage is 30,000 € and repatriation. (Medical insurances connected to credit cards are not accepted)
    4. Conditions must be stated either on insurance document or on separate confirmation letter
    5. the insurance company must be licensed to operate in Spain.
  6. Criminal record certificate for the past five years issued by the competent authorities of the country (or countries) where the applicant has lived in the five years prior to submission of the application. For applicants who have resided (or currently reside) in the UAE, the criminal record must be dully legalized, translated into Spanish or English and have been issued within three months prior to submission of the application.
  7. Payment of the visa fee.
  8. Proof of sufficient financial availability for a minimum of two years after the date of submission. These means must cover an approximate amount of 2.130 € per month (for the main applicant) and 532 € for each dependant person under the applicant’s charge (each applicant’s family member applying for residence visa). In order to prove these financial guarantees, the applicant must submit original and photocopy of the following documents:
    1. savings accounts/current account bank statements for the last 12 months
    2. bank deposits/ etc. held for the last 12 months
    3. YOUR NAME as account holder HAS TO BE STATED in every document.
Applicant’s family members (sons/daughters & spouse) must request a:
 
RESIDENCE VISA FOR FAMILY MEMBERS:  Requirements:
 
Each family member must present a separate application and a separate set of required documents.
 
Family members entitled to apply for this kind of visa:
 
Spouse
Children under 18 years
Children over 18 who are objectively unable to provide their own needs due to their state of health.
 
Requirements number 2 to number 7 mentioned above. NOTE: criminal records certificate for children only over 14 years.
For spouse: authenticated birth certificate; if the country is not UAE, the certificate must be legalized by the Spanish Consulate in the country of issuance. If the certificate is in a language other than English or Spanish, it must be officially translated into Spanish or English and the translation must be certified by the Spanish Consulate in the country of issuance.  
For children: authenticated birth certificate; if the country is not UAE, the certificate must be legalized by the Spanish Consulate in the country of issuance. If the certificate is in a language other than English or Spanish, it must be officially translated into Spanish or English and the translation must be certified by the Spanish Consulate in the country of issuance.  
 
SPECIFIC REQUIREMENTS FOR:
 
RESIDENCE VISAS FOR CAPITAL INVESTORS
  
These visas require a capital investment of at least to 2 million euros in Spanish bonds or of at least 1 million euros in the acquisition of shares of Spanish companies or deposits of at least 1 million euros in Spanish banks.
The investment has to be carried out a maximum of 60 days before the application is submitted.
The investments are justified:
  • In the case of acquisition of shares of non publicly traded companies, a certificate issued by the “Registro de Inversiones Exteriores dl Ministerio de Economía y Competitividad”
  • In the case of acquisitions of publicly traded companies, certificate of a registered broker.
  • In case of acquisition of Spanish bonds, a certificate of a bank or of the Bank of Spain accrediting the investment for a period of at least 5 years.
  • In case of a bank deposit, a bank certificate.
In case the visa is approved it will have a period of validity of one year.
 
RESIDENCE VISAS FOR BUYERS OF REAL ESTATE
 
These visas are available for those who acquire real estate property in Spain worth at least 500.000 euros.
The property must have been purchased a maximum of 90 days before the visa application is submitted.
The investment is accredited by the “certificado de dominio y cargas del Registro de la Propiedad”.
 
In case the visa is approved it will have a period of validity of one year.
 
RESIDENCE VISAS FOR ENTREPRENEURS AND ENTREPRENEURIAL ACTIVITIES
 
These visas are available for those who present a business or entrepreneurial project to be carried out in Spain and which is considered of “general interest”.
The project must be presented to the Economic and Commercial Office of the Embassy of Spain in Dubai (UAE) for evaluation. If the evaluation of the project is positive, a report will be issued which must then be presented together with the visa application in this Embassy.
 
In case the visa is approved it will have a period of validity of one year.
 
RESIDENCE VISAS FOR HIGHLY QUALIFIED PROFESSIONALS
 
These visas are available for highly qualified professional who are to be engaged by companies in Spain. It is for the company in Spain to request the residence permit through the “Unidad de Grandes Empresas y Colectivos Estratégicos”. Once the visa is approved by the “Dirección General de Migraciones”, the applicant must submit the application form and all the documents specified in the “common requirements”.
 
In case the visa is approved it will have a period of validity of one year.
 
RESIDENCE VISAS FOR EDUCATIONAL OR RESEARCH ACTIVITIES
 
These visas are available to those foreigners who intend to carry out in Spain activities in the field of research, academic activities in universities and other tertiary educational institutions and scientific and technical activities in public or private R+D institutions.
 
In case the visa is approved it will have a period of validity of one year.
 
RESIDENCE VISAS FOR INTRA-COMPANY MOVES
 
These visas are available for professionals moving within the same company. It is for the company in Spain to request the residence permit through the “Unidad de Grandes Empresas y Colectivos Estratégicos”. Once the visa is approved by the “Dirección General de Migraciones”, the applicant must submit the application form and all the “common requirements” .
 
In case the visa is approved it will have a period of validity of one year.
