Criminal Record Certificate
2/22/2021
What is the Criminal Record Certificate?

It is a certificate proving either the lack or existence of criminal records in the Central Criminal Registry on the date of issue.

The Criminal Record certificate DOES NOT ENABLE an individual to work with minors in Spain.  To work with minors, it is necessary to obtain a Certificate of Crimes of a Sexual Nature which is the only accepted document to that effect.

Who can apply for a Criminal Record Certificate at the Consulate General in Toronto?

This procedure will be only completed for Spanish citizens who are over 18 years old, live in our consular jurisdiction and are registered in our Consular Registry.

People of other nationalities different from the Spanish one will not be able to apply for this certificate through the Consulate General of Spain in Toronto. They will have to apply through the diplomatic missions of their countries accredited in Spain or directly through the Ministry of Justice.

How can I apply for the Criminal Record Certificate from abroad?

- Online through the Ministry of Justice website

The Criminal Record Certificate can be applied for online by accessing the website of the Ministry of Justice. The applicant must fill out a form and pay for the associated fee 006, through the platform of the Spanish Tax Agency for administrative fees. This option requires having an electronic DNI or a digital certificate, since the platform will request the applicant to identify and sign the form 790 electronically.

- By mail to the Ministry of Justice

The Criminal Record Certificate can be applied for by both Spanish citizens and foreigners directly by mail. In this case, the applicant living abroad must apply through the Oficina Central de Atención al Ciudadano, Sección de Penales, Ministerio de Justicia. Calle de la Bolsa, 8, 28012, Madrid; and follow the instructions appearing in the website of the Spanish Ministry of Justice.

The participation of this Consulate General in obtaining this certificate through this way is limited to certify a photocopy of the identification page of the applicant’s passport. For more information about how to certify a document in this Consulate General, check out the following link.

- Through the Consulate General, to be picked up in Spain

The Spanish citizens registered in our Consular Registry can apply for a Criminal Record Certificate at the Consulate General of Spain in Toronto. Please note that the Consulate General only submits the application and that the applicant will be responsible for picking up the Certificate issued by the Ministry of Justice in Spain, personally or through a representative, in the Territorial Administration Office of your choice.

If choosing this option, the applicant will have to come in-person (BOOK AN APPOINTMENT in the section “Antecedentes Penales”) or send the application by mail to the Consulate General of Spain in Toronto, 1201 – 2 Bloor Street East, Toronto, ON, M4W 1A8; enclosing the following documents:

- Original or notarized copy of the applicant’s DNI/passport and a photocopy. No photocopies will be done at the Consulate.

- If applicable, form authorizing a third person to pick up your Criminal Record Certificate and indicating the province where the document will be picked up.

- Consular fee.

- In the case that you submit your original DNI/passport by mail, you will have to send a prepaid PRIORITY COURIER or, preferably, XPRESS POST envelope from Canada Post.

The Consulate General will certify the copy of the document only when we have received the payment of the consular fee. You can find the amount of the consular fee in the section Fees: “Certification of documents, per certification”.

The Consulate General will send the application to the Territorial Administration Office of the Ministry of Spain in the chosen province. Around 10 business days after receiving the documents, the appointed representative can go the Territorial Administration Office of your choice to pay the  certificate fee, pick up the certificate and send it to the applicant.
