Criminal Record Certificate
CRIMINAL RECORD CERTIFICATE

What is it?
It is a certificate that can prove the lack of a criminal record or, where applicable, the existence of them.
Procedure:
There are two options to get the Criminal Record Certificate in Spain:
A/ Through a representative in Spain,
B/ Directly through the website of the Ministry of Justice (Ministerio de Justicia) in Spain.
A/ Through a representative in Spain.-
 
You must designate a person that request your Certificate and pay the fees on your behalf at the “Gerencia Territorial del Ministerio de Justicia” in the province you choose in Spain. Please, check at the website of the Ministry of Justice which office corresponds to that province:
In case you do not know any person that can help you, you can look in internet for the “Colegio Oficial de Gestores Administrativos” in that province and ask them for assistance.
To designate that person you can do it through this Consulate General and you do not need to come in person to do so. However, if you want to do it in person you do not need an appointment, just come to our offices during office hours. The documentation we need is:
1.- Two copies of your DNI or Passport. One certifies by a Canadian notary  and the other in blank, along with a Money Order or Certified Cheque in favor of the Consulate General of Spain in Toronto for the amount of the authentication (consult in our website “Consular Services / Fees” the amount of the “Testimony authenticating photocopies”).  
2.- This form filled in DATOS SOLICITANTE Actualizado.docDATOS SOLICITANTE Actualizado.doc
3.- Also this form filled in:
a/ If the province is Madrid: AUTORIZACION A REPRESENTANTE EN MADRID.docAUTORIZACION A REPRESENTANTE EN MADRID.doc.
b/ If the province is not Madrid: AUTORIZACION A REPRESENTANTE OTRAS PROVINCIAS.docAUTORIZACION A REPRESENTANTE OTRAS PROVINCIAS.doc
4.- Send these documents to our address: Consulate General of Spain. Criminal Record Certificate. 2 Bloor Street East. Suite 1201. M4W 1A8. Toronto, Ontario.
Once we receive that documentation we will send it to the Ministry of Justice in Spain.
Two weeks after sending us that documentation, your representative in Spain can go to the offices of the Ministry of Justice in the province you chose in your document to ask for your Criminal Record Certificate. This representative must provide the following documents:
  1. The Model 790 filled in.
  2. Providing proof of his/her identity.
  3. Payment of the fee.- FEE PRICE: 3,70 €
Once completed these requirements the representative should be allowed to get your Criminal Record Certificate.
B/ Directly through the website of the Ministry of Justice (Ministerio de Justicia) in Spain.-
 
This certificate must be requested directly by applicants through the following website:
To summarize, one needs to:
  1. Make a certified true copy of your passport at the Spanish Consulate (“fotocopia compulsada del pasaporte). In order to do so it is not necessary to come to this Consulate. Send us by mail a certified true copy of your passport by a Canadian notary and another copy in blank along with a Money Order or Certified Cheque for the amount of the authentication (consult in our website “Consular Services / Fees” the amount of the “Testimony authenticating photocopies”).  Send also an Express Post with your address to return your copy. Once you receive that certified true copy, you can follow the procedure as follows.
  2. Download the 790 form from the same website and fill it out.
  3. Make a wire transfer for 3.70 Euros (*) to the account below so long as the transfer is being sent from accounts open in banks located outside of Spanish territory. To send the transfer, use the IBAN or International Code for the Ministry of Justice's restricted deposit account, the details of which are provided below:

(*) Special care should be taken that the correct amount of the fee is paid, as the financial entity is not able to refund mistaken amounts paid.

     5.  Send by Registered mail the certified true photocopy of your passport along with the sheet form 790 called "Ejemplar para la Administración" and the original copy of the proof of payment to the address below:

You should receive your criminal record in about one month.
