Notarial Deeds

Please note, only residents of the following states may request public deeds or notarial acts in this Consulate General: Alaska, Counties in Northern California, Hawaii, Idaho, Montana, Nevada, Oregon, Washington, Wyoming, and Pacific Islands (Guam, American Samoa, Mariana Islands, U.S. Minor Outlaying Islands).

The granting of public deeds or notary acts cannot be carried out in an Honorary Consulate of Spain.

Granting a public deed or notary act in the United States of America so that it is valid for use in Spain, can be carried out in two ways:

A) Granting at this Consulate General

Procedure to follow:
1. Register in the Consular Register, in the case of Spanish nationals, if the applicant has not previously been registered.


2. Complete the application form for granting a public deed or notary act:

3. Send a record [minuta] of the text contained in the public deed or notary act which is to be granted as a Word document. Due to the different types of public deeds and notary acts, it is advisable to have this document drafted by a lawyer or notary in Spain.


4. Clear scan or photocopy of:
a. Passport
b. Spanish National Identification Document [DNI] and/or Fiscal Identification Number [NIF], for Spanish citizens
c. Foreign Identification Number [NIE], for non-Spanish citizens


5. In the case of granting of power of attorney, please also include:
a. Passport of the person(s) being granted power to
b. Spanish National Identification Document [DNI] and/or Fiscal Identification Number [NIF], if the legal representative is a Spanish citizen
c. Foreign Identification Number [NIE], if the legal representative is a non-Spanish citizen

 

6. If you do not speak Spanish you have to bring a traslator to help you fully comprended the deed.

The required documents should be sent via email to the following address: cog.sanfrancisco.not@maec.es or be handed in in person to the Customer Service Desk at the Consulate General.

 

Please be aware that appointments are assigned according in which they are received, and that waiting times depend on the number of applications and available resources. Appointments may not be modified. If you need your document(s) urgently, we suggest considering the second option which you can see detailed below in section B.


Appointments to come in person to the Consulate General and sign the public deed or notary act before the Consul General will only be given once all the necessary documents have been received and completed.

B) Granting before a US Notary Public or Civil-Law Notary

Should you chose this route, it is very important that you confirm prior to starting the process that the notary or property registrar in Spain accepts public deeds or notary acts which have been granted before a US Notary Public or Civil-Law Notary. In such circumstance, you will not need to undertake any further actions in this Consulate General. You should contact a local US Notary of your preference with the text of the public deed or notary act, indicating to the Notary Public or Civil-Law Notary that the document is intended for use in Spain.

Once the document has been granted before the US Notary Public or Civil-Law Notary, this document should be legalized with the Apostille of The Hague. For further information about this procedure, please refer to the following:

When the duly notarized document has been apostilled in can be used in Spain without the need for any further action.
