Residence Visa under the law 14/2013 (investors, entrepreneurs, highly qualified professionals, intra-corporate transfers, researchers, interships)

COVID -19 IMPORTANT INFORMATION:
 
 
The application for a residence visa under Law 14/2013 to support entrepreneurs and their internationalization will be presented in person or by a duly accredited representative, in official form, from Monday to Friday between 8:30 and 13:30 (NO APPOINTMENTS). 
 
Applicants must be legal residents in our jurisdiction: Florida, Georgia and South Carolina
 
B1/B2 visa holders must apply for the residence visa in the country of legal residence.
 
Honorary Consulates of Spain are not authorized to process visa applications.
 
The processing period for this type of visa can take approximately 10 business days. This Consulate General recommends that air tickets not be purchased until the visa is granted.
 
SITUATIONS
 
A)      Investors.
 
 
 
Those who make a significant capital investment, either directly (as individuals), or through a legal entity that is registered in a territory that is not considered a tax haven and provided that the beneficiary owns the majority of the voting rights in it and have the power to appoint or remove the majority of the members of its administrative body.
 
For a capital investment to be considered as significant, one of the following criteria must be fulfilled:
 
 
 
a) An initial investment with a value equal to or greater than:
 
 
 
-          2.000.000 euros in Spanish public debt securities
 
 
 
- 1.000.000 Euros in company shares or stock of Spanish capital companies with an actual business activity
 
 
 
-          1.000.000 euros in investment funds, closed-end investment funds or venture capital funds constituted in Spain
 
 
 
- 1.000.000 euros in bank deposits in Spanish financial institutions.
 
 
 
b) The acquisition of real estate property in Spain, free of all liens or encumbrances, with an investment value equal to or greater than 500,000 Euros per each applicant (the investment that exceeds this amount may be subject to liens or encumbrances)
 
 
 
c) A business project intended to be carried out in Spain that is deemed and proved to be of general interest, being necessary to be considered as such the fulfilment of at least one of the following conditions:
 
 
 
-          The creation of jobs.
 
-          Making an investment with relevant socio-economic impact in the geographic area where the activity will be carried out.
 
-          A relevant contribution to scientific and/or technological innovation.
 
 
 
The residence visa for investors may be obtained by a representative, appointed by the investor and duly accredited, for the management of a project of general interest
 
 
 
B)       Entrepreneurs
 
 
 
Those who are going to develop an entrepreneurial activity in Spain, understood as such an innovative activity with special economic interest for Spain. For the assessment, the following will be taken into account especially and as a priority:
 
 
 
a) The creation of jobs in Spain
 
b) The professional profile of the applicant
 
c) The business plan
 
d) The added value for the Spanish economy, innovation and investment opportunities.
 
 
 
C)       Highly qualified professionals
 
 
 
The following groups of professionals are in this category.
 
 a)          Management or highly qualified personnel from large companies or groups of companies or small and medium-sized companies (SMEs) from strategic sectors
 
b)         Management or highly qualified personnel who are part of a business project in which any of the following conditions exist:
 
 
 
-          A significant increase in the creation of direct jobs by the company requesting the recruitment.
 
-          Maintenance of employment.
 
-          A significant increase in the creation of jobs in the business sector or geographic area where the professional activity is to be performed.
 
-          An extraordinary investment with relevant social and economic impact in the geographic area where the professional activity is to be performed.
 
-          The concurrence of reasons of interest for Spain’s commercial and investment policy.
 
-          A relevant contribution to scientific and/or technological innovation.
 
 
 
c)          Graduates, postgraduates from renowned prestige universities and business schools.
 
 
 
D)      Researchers
 
 
 
Those who are going to carry out training, research, development and innovation activities in public or private entities. Specific:
 
a)      Research staff referred to in article 13 and the first additional provision of Act 14/2011, of 1 June, on Science, Technology and Innovation.
 
b)       Scientific and technological staff carrying out scientific research, development and technological innovation work, in business entities or R&D&I centres established in Spain.
 
c)       Researchers subject to an agreement with public or private research bodies, under the conditions set out in the regulations.
 
d)       Lecturers recruited by universities, higher education and research bodies or centres, or business schools established in Spain, in accordance with the criteria set out in the regulations.
 
 
 
 
 
E)       Workers subject to intra-corporate transfers within the same undertaking or
 
group of undertakings
 
 
 
Those foreign nationals who are posted to Spain within the framework of an employment or professional relationship or for professional training purposes with a company or group of companies established in Spain or in another country provided that they prove:
 
 
 
a)       The existence of a real business activity
 
b)       Higher or equivalent qualification, or where appropriate, a minimum professional experience of three years
 
c)       Existence of a previous and continuous employment or professional relationship of three months with one or more group companies
 
d)       Accreditation of the transfer by the company
 
NOTE.-  The visa is not a mandatory procedure for foreigners included in the scope of this Law if they are legally in Spain, since in such a case they can choose to request the residence authorization without the need for a visa before the General Directorate of Migrations of the Ministry of Employment and Social Security. Its processing is carried out by the Unit for Large Companies and Strategic Economic Sectors
 
 The Spanish Consulate General in Miami has full authority to evaluate and request additional documents to those initially submitted by the applicant.
